Chocolates are standard-rated for VAT. HMRC's Notice 701/14 lists chocolates, chocolate bars and liqueur chocolates as standard-rated confectionery, so the supplier's invoice should show VAT at the standard rate.
Given to a client, chocolates are food, so they are not deductible for corporation tax under BIM45070, however the box is branded. For VAT, no output VAT is due on gifts to one person costing £50 or less, excluding VAT, in any 12-month period. Given to staff, a box costing £50 or less including VAT can be a tax-free trivial benefit.
Prepacked chocolates must list ingredients and emphasise any of the 14 major allergens, which include milk, tree nuts, peanuts, soybeans and cereals containing gluten. If a client has a known allergy, check the product page before ordering, not after.
Shelf life and warm-weather delivery are rarely stated on chocolate gift listings, so ask the maker if you are ordering ahead or sending in summer. If you send a gift directly to a client, check whether the parcel includes a price: Rococo, for example, says it does not put invoices in the shipment box.
